CANCELLATION POLICY
Please note that because retreats hosted by Akash Yoga LLC and Vienna D’Aprile, LMHC are limited to a small number of attendees to allow for a more personable, intimate experience, our cancellation policy is in place to help guests and us alike work together sharing expenses that may arise from unexpected cancellations.
1. HOLD DEPOSITS ARE NON-REFUNDABLE and NON-TRANSFERABLE.
2. Full balance due 30 days before retreat start date.
3. For cancellation requests submitted at least 60 days in advance of retreat date, 50% of total amount (less deposit) will be refunded.
4. Within 60 days of the first day of your retreat, no refunds given, no exceptions.

No one books a retreat with the intention of canceling, but unexpected events do occur, so please consider purchasing travel insurance and it is your responsibility to read and understand our cancellation policies. Exceptions cannot be made for any reason, including weather, injury/illness, or personal emergencies. No refunds or credits will be granted for failure to attend or failure to complete the retreat, or for arriving late or leaving early. We recommend that you purchase your own travel insurance. We encourage you to purchase trip cancellation insurance in order that your trip fees will be covered should you or your family have a medical problem prior to your trip or while on the trip. Trip insurance should also be purchased to cover medical expenses in the event you have an accident while on the retreat. Most travel insurance must be purchased within 14 days of making your reservation. We reserve the right to cancel retreats with inadequate participant interest, in which case all money paid to Akash Yoga LLC and Vienna D’Aprile, LMHC will be refunded. Notification of cancellation for this reason will occur at least 30 days prior to retreat start date. Akash Yoga LLC and Vienna D’Aprile, LMHC shall not be held responsible for any personal expenses, such as airline tickets due to changes in itineraries or retreat cancellations.
I hereby acknowledge, accept, and agree that participation in the Yoga and Wellness retreat and/or observation of such activities involves inherent risks. I have received full information regarding the Yoga retreat and have had the opportunity to ask any questions that I wished. I understand that no amount of care, caution, instruction, or expertise can eliminate the inherent dangers associated with these and other activities. I have full knowledge of the nature and extent of all the risks associated with the Yoga retreat, including, but not limited to:
All manner of injury resulting from participation in the retreat
Injuries resulting from the actions or omissions of others
Failure to follow Akash Yoga LLC or Vienna D’Aprile, LMHC employee instruction or failure to ask for information or assistance
Anxiety, emotional distress, heart failure, or other medical issues in any way related to the Yoga and Wellness retreat.
I further acknowledge that the above list is not inclusive of all possible risks associated with the use of the yoga retreat and in no way limits the extent or reach of this assumption of risk, release of liability, and indemnification. I understand that no amount of care, caution, instruction or expertise can eliminate the inherent dangers associated with these and other activities. I confirm that I am physically and mentally capable of participating in the Yoga retreat. I understand that if my mental or physical condition changes after the execution of this Release such that I am not capable of participating in the Yoga and Wellness retreat activity, I am obligated to cease participation in the activity or activities immediately.
RELEASE AND INDEMNIFICATION.
I agree to accept and assume all of the risks existing in these activities, both known and unknown, either caused or alleged to be caused, by the negligent acts or omissions of Akash Yoga LLC, Vienna D’Aprile, LMHC, and others. My participation is purely voluntary, and I elect to participate in spite of the risks. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Akash Yoga LLC, Vienna D’Aprile, LMHC, their officers, owners, members, affiliates, agents, and employees and any person or entity working on their behalf, as well as any other persons, corporations, or other entities that might have any liability to me (collectively, the “Released Parties”), from and against any and all damages, actions, claims, suits, demand actions, and liabilities, whether known or unknown, anticipated, suspected or unsuspected, now or any time in the future, in any way relating to or arising from any activity, occurrence or event, whether supervised or not, including, without limitation, all claims for property damage, personal injuries, or wrongful death involving the Yoga retreat, and/or Akash Yoga LLC, Vienna D’Aprile, LMHC, or any of the Released Parties, including claims that allege negligent acts or omissions, and claims pertaining to all matters connected with travel, sightseeing journeys and transportation, late departures or change of schedule, strikes or to their conditions, nor will Released Parties be responsible for loss or damage to baggage or any of the participant's belongings, excepting only gross negligence, or intentional, willful, or wanton misconduct of Released Parties.
I understand and agree that Akash Yoga LLC, Vienna D’Aprile, LMHC, and their personnel reserve the right to deny access to the Yoga and Wellness retreat to any individual, permanently or for any specified period of time, for any breach of Akash Yoga LLC and/or Vienna D’Aprile, LMHC’s policies, rules and regulations, or for any conduct that is viewed as unsafe or inappropriate. I further understand and agree that I am solely responsible for my personal property while it is at any Akash Yoga LLC and/or Vienna D’Aprile, LMHC facility or event. Akash Yoga LLC and Vienna D’Aprile, LMHC and their personnel assume no responsibility for any lost or stolen personal property. I also understand and agree that it is my responsibility to keep all personal property under observation or secured. If I become the victim of a theft, I will report it immediately to Akash Yoga LLC and/or Vienna D’Aprile, LMHC personnel.
Should Akash Yoga LLC and/or Vienna D’Aprile, LMHC, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
TO BE SIGNED BY THE PARTICIPANT
I am at least 18 years of age and otherwise legally competent to sign this agreement. This Release of Liability, Assumption of Risk, Indemnification, and Participation Agreement shall be effective and binding upon me and upon my assigns, heirs, representatives, executors, and administrators. My participation in the Yoga and Wellness retreat is purely voluntary, and I elect to participate in spite of the risks. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions that could interfere with my safety, or else I am willing to assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition. I have had sufficient opportunity to read this entire document. I have had the opportunity to ask questions about this document. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in the Yoga retreat, activities at Akash Yoga LLC and/or Vienna D’Aprile, LMHC facilities or involving Akash Yoga LLC and/or Vienna D’Aprile, LMHC, I may be found by a court of law to have waived my right to maintain a lawsuit against Akash Yoga LLC, Vienna D’Aprile, LMHC, or any of the other Released Parties on the basis of any claim from which I have released them herein. I further agree to indemnify, hold harmless and defend the Released Parties from and against any loss, damage, liability, expense, costs, and/or attorneys’ fees arising from my participation in the Yoga retreat, activities at Akash Yoga LLC and/or Vienna D’Aprile, LMHC facilities or affiliated events.
I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS AND IMPLICATIONS. I HEREBY AGREE TO ALL OF THE TERMS AND CONDITIONS STATED HEREIN.
